Most violations found by EPH Investigators are resolved through notification of the violation and education of the laws and regulations being violated.Persistent and substantial violations can result in the issuance of a citation or a civil or criminal lawsuit being filed through the County Attorney’s Office or the District Attorney’s Office. What do I do when I am inspected by an EPH
investigator and found to be in violation? If given a Citation to appear at County Justice of the Peace Court you must do so. If you are given a Violation Notice it will explain what you were doing that violated the law, and exactly what law you violated. The Violation Notice will state that you have 10 days to respond. This should be a written response and can be mailed to:
If for some reason you cannot send a written response or you miss the 10-day deadline, call and speak to the Investigator. Give the Investigator a verbal response or ask for an extension. Your response is very important in the decision as to the ultimate disposition of your case.
